2. Definitions
- “Client” or “You”: The person(s) booking travel services.
- “Services”: Tour packages, travel arrangements, and related services.
- “Tour”: Any travel itinerary or experience provided by the Company.
- “Third Party Suppliers”: Hotels, transport providers, guides, and other service providers.
- “Force Majeure”: Events beyond our reasonable control including natural disasters, government actions, strikes, or pandemics.
3. Booking and Confirmation
3.1 Booking Process
- All bookings must be made through our authorized channels (website, email, or phone).
- Bookings are subject to availability at the time of confirmation.
- We reserve the right to refuse any booking at our discretion.
- All travelers must provide accurate personal information as required.
3.2 Booking Confirmation
- Bookings are confirmed only upon receipt of required deposit and written confirmation from us
- A signed booking confirmation constitutes acceptance of these Terms
- All details in the booking confirmation are deemed correct unless notified within 48 hours
3.3 Age Requirements
- Travelers under 18 must be accompanied by a responsible adult
- The adult is responsible for the conduct and safety of minors in their care
- Special requirements for minors must be disclosed at booking
4. Pricing and Payment
4.1 Pricing
- All prices are quoted in USD unless otherwise specified.
- Prices include services as specified in your itinerary confirmation
- Prices may vary based on season, availability, and group size
- We reserve the right to correct pricing errors at any time
4.2 Payment Terms
- Deposit: 30% of total tour cost required to confirm booking
- Balance: Full payment due 30 days before tour departure
- Last-minute bookings: Full payment required at time of booking
- PGroup bookings: Special payment terms may apply
4.3 Payment Methods
- Bank transfer to our designated account
- Cash payment at our office
- Credit card payments (when available)
- All bank charges and transaction fees are client’s responsibility
4.4 Price Changes
- Prices may change due to currency fluctuations, fuel costs, or supplier price increases
- Confirmed bookings are protected from price increases after full payment
- We reserve the right to cancel tours if price increases exceed 10% of original cost
5. Cancellation and Refunds
5.1 Cancellation by Client
Cancellation charges apply as follows:
- More than 45 days before departure: 25% of total cost
- 31-45 days before departure: 50% of total cost
- 15-30 days before departure: 75% of total cost
- Less than 15 days before departure: 100% of total cost (no refund)
5.2 Cancellation by Company
We may cancel tours due to:
- Insufficient minimum group size (where applicable)
- Force Majeure events
- Safety concerns or government restrictions
- Supplier cancellations beyond our control
In case of Company cancellation:
- Full refund of all payments made
- No compensation for other travel arrangements or expenses
- Alternative tour options may be offered
5.3 Refund Process
- Refunds processed within 30 days of cancellation
- Refunds made to original payment method where possible
- Bank charges and transaction fees may be deducted from refunds
6. Travel Documents and Requirements
6.1 Passport and Visa
- Valid passport required with minimum 6 months validity
- Appropriate visa/ETA required for Sri Lanka entry
- Clients responsible for obtaining correct travel documents
- We provide guidance but are not responsible for document issues.
6.2 Health Requirements
- No specific vaccinations required for most travelers
- Clients should consult healthcare providers for medical advice
- Any health conditions must be disclosed at booking
- Travel insurance strongly recommended.
6.3 Travel Insurance
- Comprehensive travel insurance mandatory for all travelers
- Insurance must cover medical emergencies, trip cancellation, and personal belongings
- Clients responsible for arranging adequate coverage
- We can recommend insurance providers but are not responsible for claims
7. Tour Services and Inclusions
7.1 Services Included
Tours include services specifically mentioned in your confirmed itinerary:
- Accommodation as specified
- Transportation as outlined
- Meals as indicated
- Entrance fees to attractions listed
- Local guide services where mentioned
7.2 Services Not Included
Unless specifically mentioned, tours do not include:
- International airfare
- Travel insurance
- Personal expenses and souvenirs
- Optional activities not in itinerary
- Tips for guides and drivers
- Meals not specified in itinerary
7.3 Accommodation Standards
- Accommodation provided as per category booked
- Room assignments based on availability at check-in
- Single travelers may be required to pay single supplement
- Special requests accommodated subject to availability
8. Changes and Modifications
8.1 Changes by Client
You have the right to:
- Changes to confirmed bookings subject to availability and supplier policies
- Change fees may apply depending on timing and nature of change
- Price differences for upgraded services payable by client
- No guarantee that changes can be accommodated
8.2 Changes by Company
We reserve the right to modify itineraries due to:
- Weather conditions or safety concerns
- Supplier cancellations or closures
- Government restrictions or force majeure events
- Operational requirements
When we make changes:
- Alternative arrangements of similar standard provided where possible
- No compensation for minor itinerary adjustments
- Significant changes may entitle clients to cancellation with full refund
8.3 Marketing Communications
You can unsubscribe from marketing emails at any time by:
- Clicking the unsubscribe link in emails
- Contacting us directly at info@ingaescapes.com
- Updating your preferences in your account.
9. Client Responsibilities and Conduct
9.1 Personal Responsibility
Clients are responsible for:
- Arriving at designated meeting points on time
- Following guide instructions and local laws
- Maintaining appropriate behavior during tours
- Ensuring personal safety and security of belongings
- Respecting local customs and cultural sensitivities
However, no internet transmission is completely secure, and we cannot guarantee absolute security.
9.2 Health and Fitness
Clients are responsible for:
- Clients must be in reasonable health for chosen activities
- Any medical conditions or physical limitations must be disclosed
- We reserve the right to exclude participants unsuitable for specific activities
- Medical emergencies may result in tour modifications at client’s expense
9.3 Unacceptable Behavior
We reserve the right to remove clients who:
- Endanger themselves or others
- Disrupt the enjoyment of other travelers
- Refuse to follow guide instructions or local laws
- Engage in illegal activities
- Show disrespect to local communities or customs
10. Liability and Insurance
10.1 Company Liability
- Our liability is limited to the cost of services provided
- We are not liable for acts or omissions of third-party suppliers
- No liability for personal injury, illness, or death except where caused by our negligence
- Not responsible for loss or damage to personal belongings
- Force majeure events exclude us from liability
10.2 Third Party Suppliers
- Hotels, transport companies, and activity providers are independent contractors
- We act as agent in arranging these services
- Suppliers’ terms and conditions apply to their services
- Claims against suppliers must be made directly with them
10.3 Maximum Liability
- Total liability limited to the total cost paid for tour services
- No liability for consequential, indirect, or punitive damages
- No compensation for lost time, missed connections, or alternative arrangements
11. Photography and Marketing
11.1 Use of Images
- We may photograph or video record tours for marketing purposes
- Participation in tours constitutes consent to use of images
- Clients may opt out of photography at any time
- Images may be used on websites, social media, and promotional materials
11.2 Client Photography
- Clients may photograph and share their experiences
- Respect for local customs and privacy laws required
- Some locations may restrict photography
- Commercial use of images featuring our services requires permission
12. Force Majeure
We are not liable for failure to perform services due to circumstances beyond our reasonable control, including:
- Natural disasters (earthquakes, floods, storms)
- Government actions or travel restrictions
- Strikes, civil unrest, or terrorism
- Pandemic or health emergencies
- Supplier failures due to force majeure
In such cases, we will endeavor to provide alternative arrangements but cannot guarantee refunds or compensation.
13. Complaints and Disputes
13.1 Complaint Process
- Issues during tours should be reported immediately to guides or local representatives
- Written complaints must be submitted within 30 days of tour completion
- We will investigate all complaints and respond within reasonable time
- Opportunity for resolution will be provided where appropriate
13.2 Dispute Resolution
- Good faith efforts will be made to resolve disputes amicably
- Unresolved disputes subject to arbitration in Colombo, Sri Lanka
- Sri Lankan law governs all disputes
- Legal proceedings must be filed within one year of tour completion
14. Data Protection and Privacy
- Personal information collected and used in accordance with our Privacy Policy
- Data shared with suppliers only as necessary for service delivery
- Marketing communications require explicit consent

- Unauthorized use or reproduction prohibited
